Hi all, I was hoping that I could get some guidance as to how I should proceed with this. Thank you in advance. The accident occurred 7 days ago in CA. I was driving home from work in the 4th lane of a 4 lane highway. There was a gap of approximately 4~5 cars in the 3rd lane, so I switched into that lane. By the time I finished the lane change, there was approximately 3~4 cars distance between me and the car behind me. I then drove for approximately a 100 yards, at which point the traffic suddenly slowed and I decelerated. The guy behind me, however, seems to have been looking elsewhere and rear ended me. However, before he collided, he managed to swerve his car and hit the corner of my rear bumper with the corner of his front bumper. We pulled over to the side of the road and exchanged information. It turns out that he does not have a driver's license (or any California/U.S. ID; he showed me a Mexican ID). He begged me not to call the police, admitted fault and said that he would settle it through his insurance (he is insured with a VERY shady place called Access General). I took pity on him, especially since it was very likely that he is an illegal immigrant, so I just took his information down and moved along. Fast forward a few days, and I find out that he has told his insurance that I cut in front of him and that he is not at fault. Since there are no witnesses or a police report, his insurance takes his side. Meanwhile, since I only have liability with Geico, they are saying that they can't help me. The damage to my car is between $4~5k, and that is not even taking into account devaluation of the car's value. I feel very cheated because I took pity on him and I am rewarded with a repair bill that nobody wants to deal with. I have called him multiple times and asked him to tell the truth, but he just ignores me. I am now very angry and want to do 2 things: 1. Get my car repaired. 2. Screw up his life. Hopefully get him deported (very strong liklihood of him being an illegal immigrant), or at the least bankrupt him. I took pity on him because he was in a time of need. All he had to do was tell the truth to his insurance, but he was afraid that his monthly bill would go up... so he lies and screws me instead. Do you have any recommendations for lawyers who would be willing to take on property damage lawsuits? What are my options?

I am a Marine Stationed at Camp Pendleton, California. About eight months ago I allowed my room mate to drive my Jeep while I was away attending pre-deployment training for Afghanistan. While there he rolled my Jeep literally down a mountain while under the influence of alcohol. Needless to say the Jeep was totalled and is Unrecoverable from the canyon were it now rests. So, I recently paid off all my debt that was racked up from an irresponsible boyfriend. My score is in the high 600's, so pretty mediocre....but I'm relieved that I don't have any debt. The insurance I pay on my car is a higher quote than normal due to my credit and I'm just curious why that would influence the rates. How does having past outstanding debt mean I am a bad or unsafe driver? I am 30, have a college degree, have a good job, don't have anything negative on my driving record. I recently was bumped into in my parking lot and am trying to settle with their insurance company for how much the repair fee would be. I took it to one place and it was around $2100 with damage to both the front and back door (they said the front door would need to be replaced). I spoke with their insurance company and they said I needed to take it to their place to have an estimate. I took it to their place, and the guy asks me if I was going to have it repaired their or somewhere else. I told him I would get it repaired somewhere else, which meant I would get a check he told me. He inspected it and told me that there was a 50-50 chance it would need to be replaced on the front door so his estimate was only for $1300. He said if I go get it fixed and they say it is more, that their insurance will pay the difference. This sounded to me like they are trying to say if you want the cash you only get $1300. What should I do? Should I try to negotiate with their insurance company for the difference or get more estimates that say I would need the new door? I would like the check, but I feel like I am getting ripped off since it would take more to actually fix it more than likely.

I found a nice little car, a 2001 RENAULT CLIO, 1.2 16V 3dr Hatchback. I used a price comparison site to get a basic idea of what the insurance would be on it - and using my real own details and it was 5993. So I messed around a bit and added my mum as a second/extra driver. The price crashed down to 3,153. The option to add another driver was still there so I added my dad too and the price is now 2,617 - much more in my price range. I called them in and was like look at this and what do you think and they both agreed that there was something wrong with it and there would be a catch somewhere but I disagree. They said it would affect their own no claims however when added a extra driver no information about an extra driver is there. Are they right that there would be a catch? I have one at fault accident on my record. It was a rear-end collision and it is a 2 pt. accident in California. I was shopping for new insurance. I made this statement about the at fault accident when filling out the forms for a quote online. At first GEICO the GEICO rates were looking way better than Progressive or other insurance companies so I thought I'd go with them. But when I went to go pay online, they did one last DMV record check, and came back with a higher rate. Even though I had stated the accident in the form previously. They waited to verify this at the very end and not earlier which I found annoying--they had my driver's licence earlier in the application process, so why wait till the very end! When filling out the Progressive quote forms, I also stated the info about my accident where asked. At the end, the form still considered me a Good Driver and the quote was much cheaper than Progressive. I went to pay and it did not recalculate my quote after a DMV check like GEICO did. I paid and am wondering if I am going to hear back from them saying I need to pay more. But I gave them all the info and I do now have a policy. So it appears that GEICO is tougher when it comes to having an accident, and Progressive doesn't let one at fault accident ruin a good driver discount? Does anyone have experience with this?

Hi, my car insurance covers for liability only and now I have an accident with a big truck. The big truck hit my car from the side. We were driving from 2 lanes next to each other and at one point the two lanes combine into one. While I was alittle pass over the truck, it hit me from the side. Their side has no damage since it is a big truck and our side has damaged from the driver side. The police report didn't explain clearly about whose fault it is except it mentions what the two drivers said. I think it is not my fault and the other driver denied it is his fault either. My insurance company didn't help much because we only have liability. Now, the other party insurance company called me and said they can't pay for the damanges since it is both parties fault. Therefore, pay for damanges on our own. Like I said, the other party didn't have any damages. If we have to fix it by ourselves, it will cost over $1500. :-( How should I fight with the insurance company to get my claims?

Is full comp' car insurance worth having ?

Apart from paying lower premiums and having to pay for repairs to ones own vehicle are there any disadvantages to just having third party fire and theft insurance ? I've had full comp for years, my car (10 years old ) was walloped by an unknown driver reversing in my driveway which caused broken lights and superficial bodywork damage, I've since been told by my insurance company that it's not economically viable to repair it - they would write it off less a 150 excess fee. Apparently, according to my garage this is common practise on any car over five years old. Yet at no time did the insurance company advise me of this so essentially I was paying extra for nothing. So, do you know of any other reason why I should keep the full comp' or just change to third party ?

False car insurance report?

Me and my boyfriend were in an accident on New Year's Eve in his father's car. Our car was totaled, and since the accident was entirely the other party's fault and their insurance had to cover everything. My family made me go to the emergency room to make sure nothing was wrong with me, and I was told that if I sent the bill to the other lady's insurance they would have to cover it. Well the bill came and when we sent it to his father to send it to the other insurance company he said that he claimed only his son was in the car. Now I'm stuck with a huge bill that I'm trying to find a way out of, but since he lied to the insurance I don't think I can send it to them. There were witnesses and the lady knew I was in the car. Is him lying on the report considered fraud?

I just got off the phone with my auto insurance to change my address. They informed me that my rate is going to be $16 more now because I moved to a different zip code. The problem is, I had previously had my insurance changed because it skyrocketed after my previous move. Which is strange because I had moved from the same city before and it went down about $20. I have since moved BACK to the SAME city I was in before and it's going up again?? This makes NO SENSE! I thought it was based off of your location (zip code). But now I just think these insurance companies are making up their own numbers and rules and we're all getting screwed!! Can someone please explain this insanity to me? My zip code is now and was before, 95608. The zip code I just moved from is 95628. Yes, I have moved back and forth 4 times within the same 2 cities if you're confused.

I think it is horrible that they base car insurance rates on your credit history. Having bad credit doesn't make you a bad driver. If they are worried about you paying the bill, why do they make it HIGHER if you have bad credit? Isn't that a little messed up? Are there any companies that don't do this?
